2 . General Provisions

2.1. Scope of the Rules

These Rules govern the use of the Website, including Registration, creation and use of Bots, connection of OLX Accounts, purchase and use of Paid Services, payment procedures and complaint handling. Every person using the Website is obliged to familiarise themselves with these Rules and comply with them.

2.2. Functional description

The Service enables Users to, in particular:

  • configure automated assistance for responding to inbound OLX messages based on predefined keywords and templates;
  • generate AI Output using AI models provided by AI Providers;
  • view and manage dialogues with OLX users within a single interface;
  • connect Bots to Listings to handle inbound inquiries more efficiently.

The User cannot initiate a new OLX conversation via the Service; messages may be sent only in response to messages initiated by other OLX users.

2.3. Acceptance of Rules

Browsing the public pages of the Website does not by itself create a contractual relationship for Paid Services.

The User accepts these Rules by taking an affirmative action where required by the Service, including in particular by:

  • registering an Account;
  • purchasing a Paid Service; or
  • expressly accepting an updated version of the Rules where such express acceptance is required under these Rules or applicable law.

A person who does not accept these Rules should refrain from registering an Account or purchasing Paid Services.

2.4. Changes to the Rules

PulsGPT may amend these Rules as described in Section 12.

2.5. Legal compliance and third-party rules

Users must use the Service in full compliance with applicable laws and with OLX platform rules and any other third-party terms necessary for lawful interaction with those services.

2.6. Technical requirements

To use the Website, the User’s device must in particular:

  • have continuous Internet access supporting HTTPS;
  • have an up-to-date web browser supporting HTML5 and CSS3;
  • have JavaScript and cookies enabled.

2.7. Dependence on external services

PulsGPT depends on the availability and correct functioning of external services, including OLX and one or more AI Providers. PulsGPT does not control those services and is not responsible for their operation. Interruptions, changes or failures of such services may affect the functioning of PulsGPT.

2.8. Service interruptions

PulsGPT strives to ensure uninterrupted operation of the Service but may temporarily suspend or limit functionality to:

  • perform technical maintenance; or
  • address technical failures, including failures caused by external services.

2.9. Processing of conversations and data

PulsGPT may process content and metadata necessary to provide the Service, maintain security, prevent abuse, comply with law, provide support, and perform limited analytics or service improvement activities, as further described in the Privacy Policy. Users are responsible for ensuring they have the necessary rights and lawful basis to process and send content via the Service.

2.10. No warranty; third-party platforms

  • The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, PulsGPT disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
  • PulsGPT does not warrant uninterrupted or error-free operation. The Service may be affected by the availability, policies, rate limits or technical changes of third-party services (including OLX and one or more AI Providers). PulsGPT is not responsible for third-party outages, changes, restrictions or enforcement actions.

2.11. Limitation of liability

  • To the maximum extent permitted by applicable law, PulsGPT shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, data or business opportunities.
  • To the maximum extent permitted by applicable law, PulsGPT’s total aggregate liability arising out of or related to the Service shall not exceed the total fees paid by the User for Paid Services in the three (3) months immediately preceding the event giving rise to the claim.
  • Nothing in these Rules limits or excludes liability where such limitation or exclusion is prohibited by mandatory law, including mandatory consumer protection laws.

2.12. Force Majeure

The Parties shall be exempt from liability for partial or complete failure to perform their obligations under these Terms if such failure is caused by force majeure circumstances arising after the acceptance of these Terms as a result of extraordinary events that the Parties could not have foreseen or prevented. Such circumstances include, but are not limited to: natural disasters, acts of war, acts of terrorism, strikes, power outages, global disruptions of the Internet or backbone communications providers, as well as unlawful acts of third parties aimed at compromising the security or normal operation of the Service (including DDoS attacks). Upon the occurrence of such circumstances, the period for the performance of obligations shall be extended for a time proportionate to the duration of such circumstances and their consequences.

3 . Account

3.1. Requirement to register

To access the main functionality, including Paid Services, a Guest must register an Account and become a User.

3.2. Scope of Account functionality

An Account may include the ability to:

  • create and manage Bots;
  • connect, manage and deactivate OLX Accounts;
  • view Listings and conversations associated with connected OLX Accounts (subject to plan limits);
  • connect Bots to Listings and disconnect them;
  • purchase and manage Paid Services;
  • receive inbound messages from OLX users and send responses to them, subject to these Rules.

3.3. Eligibility

Only a natural person with full legal capacity, a legal entity or a separate organisational unit with legal capacity may become a User. In the case of legal entities or separate units, only a person duly authorised to act on their behalf may create and use an Account.

3.4. Registration process

To register an Account, the User must:

  • complete the registration form and provide required data (e.g., email/phone and password) or use an external authentication provider; and
  • read and accept these Rules and any applicable annexes.

At the point of registration, PulsGPT shall make the Privacy Policy available to the User in a clear and accessible manner.

3.5. Accuracy of data

The User warrants that data provided during Registration and later use are accurate and up-to-date. PulsGPT may restrict or block the Account if the data are clearly incorrect, incomplete or raise reasonable doubts.

3.6. Security of access data

The User must keep login credentials confidential. If unauthorised access is suspected, the User must immediately change the password (if possible) and notify PulsGPT.

3.7. Duration and termination of Account agreement

The Account service agreement is concluded for an indefinite term upon Account activation.

The User may delete the Account at any time by:

  • using the dedicated option in the Account panel; or
  • sending a clear request to PulsGPT support.

Deletion takes effect for the future. Deleting the Account does not automatically terminate obligations arising from unpaid amounts (if any), or from any ongoing dispute, chargeback, payment reversal, or refund process handled by PulsGPT, an authorised payment service provider, or a Merchant of Record.

PulsGPT may retain certain data after Account deletion where required by applicable law, reasonably necessary for the establishment, exercise or defence of legal claims, fraud prevention, chargeback handling, security, accounting, tax, or compliance purposes, in accordance with the Privacy Policy.

3.8. Termination by PulsGPT

PulsGPT may terminate the Account agreement or restrict the Account where:

  • the User has not logged in for at least 12 consecutive months and, after prior notice, does not log in within an additional time specified;
  • the User repeatedly violates these Rules or applicable law;
  • the User fails to pass verification reasonably required to protect the Service or other users.

3.9. Consumer rights

If the User is a Client (consumer), mandatory consumer laws may grant rights related to digital services and digital content, including rights in relation to withdrawal, conformity, remedies for failure to supply, lack of conformity, price reduction, termination, or refund, where applicable under mandatory law.

Nothing in these Rules limits any mandatory statutory consumer rights that cannot legally be excluded or restricted.

4 . OLX Accounts

4.1. Connection via official OLX authorisation methods (OAuth)

  • The Service connects to an OLX Account only through official authorisation methods provided by OLX, such as OAuth authorisation flows (where available). The Service does not require the User to share their OLX password with PulsGPT.
  • During connection, the User is redirected to the OLX Website (or other official OLX authorisation screen) to authenticate and grant the requested permissions. The scope of permissions and the access duration are determined by OLX and may change from time to time.
  • The User may revoke PulsGPT’s access at any time using OLX account settings (where available) or by disconnecting the OLX Account in the Service. If access expires or is revoked, the User must re-authorise to continue using OLX-related functionalities.
  • The User represents and warrants that they are authorised to connect and use the relevant OLX Account and Listings, and that such connection and use will comply with OLX rules and applicable law. PulsGPT may suspend or disable OLX-related features if it reasonably believes the integration violates OLX rules, applicable law, or threatens the security or stability of the Service.

4.2. Active OLX Account limits

The maximum number of Active OLX Accounts is defined by the User’s current Subscription Plan or Package (if any). If the User has both a Subscription Plan and one or more Packages, the applicable limit is the highest available limit only, and such limits do not accumulate. PulsGPT may block activation of OLX Accounts above the relevant limit.

4.3. Connected and active OLX Accounts
The Service may allow the User to connect more OLX Accounts than may be active at one time, but only the number of Active OLX Accounts permitted under the applicable Subscription Plan, Package, or free access rules may be used simultaneously.

4.4. Free access limitation
Unless otherwise stated, a User without an active Subscription Plan or relevant Package may have no more than one (1) Active OLX Account at a time.

4.5. Responsibility for OLX Accounts

The User is solely responsible for lawful use of connected OLX Accounts, including compliance with OLX rules and any obligations towards OLX or other third parties.

5 . Bots and AI Output

5.1. Responsibility for content

The User is responsible for messages sent via OLX using the Service. PulsGPT provides technical tools and does not pre-approve or control the content of messages before they are sent.

5.2. Obligations of Users

Users must comply with applicable laws and OLX rules when configuring and using Bots, including laws concerning consumer protection, personal data protection, advertising, unfair competition and intellectual property.

5.3. Prohibited content

Users may not use Bots to create or send messages that:

  • contain unlawful, hateful, threatening, defamatory, pornographic or otherwise prohibited material;
  • promote illegal activities, including fraud or malware; or
  • infringe third-party rights.

5.4. Consequences of violations

If PulsGPT becomes aware of likely violations, it may, depending on severity:

  • suspend or delete a Bot;
  • restrict or block the Account; or
  • notify competent authorities or affected third parties where appropriate.

5.5. Use of content created by Bots

Content created by Bots belongs to the User. By using the Service, the User grants PulsGPT a non-exclusive licence to use such content solely to:

  • operate, maintain and provide the Service;
  • monitor compliance with these Rules and law; and
  • analyse aggregated and anonymised data.

5.6. AI Output disclaimer and User responsibility

  • The Service may generate AI Output. AI Output may be inaccurate, incomplete, misleading, inappropriate, or unsuitable for a particular purpose and does not constitute professional, legal, financial, tax, or other regulated advice.
  • The User remains solely responsible for configuring, enabling, supervising, reviewing, editing, approving, and using any Bot, automated messaging, and AI-assisted functionality, including any message sent automatically without prior manual review. The User must ensure that all such messages comply with applicable law, OLX rules, and these Rules.
  • The User uses AI Output and automated functionality at their own risk. PulsGPT does not guarantee that AI Output or automated messaging will be accurate, lawful in a particular context, uninterrupted, or achieve any specific result, including increased sales, conversion, response rates, customer satisfaction, or compliance outcomes.

6 . Connections

6.1. General use

A Connection allows the User to link a specific Listing to a Bot so that the Bot may process messages related to that Listing.

6.2. Connections from Subscription Plans

  • The number of Connections available under a Subscription Plan is determined by the selected plan and applies only during the current Subscription Period;
  • A Subscription Period lasts from the date of successful purchase or renewal until the corresponding date of the following calendar month;
  • Connections granted under a Subscription Plan may be activated and used at any time during the active Subscription Period;
  • Any Connection granted under a Subscription Plan remains valid only until the end of the relevant Subscription Period, regardless of the date on which it was activated;
  • Unless explicitly stated otherwise, unused Connections from a Subscription Period do not roll over to the next Subscription Period and expire at the end of that Subscription Period.

6.3. Connections granted under a Package

  • Connections credited under a Package may be activated and used during a period of one month starting from the date on which the Package was successfully purchased or credited to the User;
  • Any Connection granted under a Package remains valid only until the end of that one-month validity period, regardless of the date on which it was activated;
  • After the end of that validity period, any unused or active Connections from the Package expire automatically and are not restored.

6.4. Validity of activated Connections

  • A Connection activated from a Package remains valid until the end of the applicable Package Period, regardless of the activation date.
  • Releasing (disconnecting) a Connection does not extend the Package Period or the validity of any Connection.

6.5. Deactivation and reuse

The User may deactivate a Connection at any time. Deactivation does not extend its validity period. A released Connection may be reused only within its original validity period.

7 . AI Provider Tokens

7.1. Token calculation

AI Provider Tokens used in a request are determined by the applicable AI Provider and generally include:

  • text of the User’s or Bot’s message;
  • configuration/system texts;
  • relevant dialogue history included in the prompt;
  • the generated output.

7.2. Output length

Output length may be limited by AI Provider and by Bot settings.

8 . GPT Tokens

8.1. General rule

PulsGPT uses GPT Tokens as an internal billing unit for AI-generated responses and related AI functionality.

8.2. GPT Tokens granted under a Package

  • GPT Tokens credited under a Package may be used during a period of one month starting from the date on which the Package was successfully purchased or credited to the User, unless explicitly stated otherwise at the time of purchase;
  • After the end of that validity period, any unused GPT Tokens from the Package expire automatically and are not refundable.

8.3. GPT Tokens granted under a Subscription Plan

  • GPT Tokens credited under a Subscription Plan remain available and may roll over into subsequent Subscription Periods while the Subscription Plan remains active and successfully renewed;
  • If the Subscription Plan is not renewed for the next Subscription Period for any reason, including payment failure, cancellation by the User, expiration of the payment authorisation, or rejection by the payment provider, all previously unused GPT Tokens credited under that Subscription Plan become inactive and unavailable;
  • If all renewal payment attempts fail and the Subscription ends, the User loses access to all unused GPT Tokens previously accumulated under that Subscription Plan;
  • After the Subscription ends, such inactive GPT Tokens are not restored, reactivated, renewed, or refunded, even if the User later purchases a new Subscription Plan;
  • A new Subscription Plan started after the end of a previous Subscription Plan is treated as a new and separate subscription cycle and does not restore any unused GPT Tokens from a previous inactive Subscription Plan.

8.4. Changes in AI Provider pricing

PulsGPT may adjust multipliers and consumption rules in line with changes in AI Provider pricing or technical capabilities. Material changes will be communicated in advance where feasible.

9 . Payment, Subscriptions and Packages, Consumer Right to Cancel, Refunds

9.1. Prices, currency, taxes

Current prices for Paid Services are displayed on the Website, in the User’s Account, and/or in the checkout interface before purchase.

Prices may be displayed in different currencies depending on the User’s location, selected country, applicable pricing configuration, payment method, taxation rules, or payment provider capabilities.

The final payable amount, applicable taxes, and the currency of charge are shown to the User before the payment is confirmed in the checkout or invoice interface. The amount shown at checkout immediately before payment confirmation is the binding purchase amount.

The currency displayed on a pricing page or elsewhere in the Service may differ from the currency actually charged by the payment provider or the User’s bank. Currency conversion and any related fees applied by the payment provider or the User’s bank are outside PulsGPT’s control.

Where required by applicable law, taxes may be calculated and presented based on information such as the User’s selected country, billing information, IP address, payment method, payment provider data, or other relevant evidence.

9.2. Payment processing model

Payments for Paid Services may be processed either:

  • directly by PulsGPT through an authorised payment service provider; or
  • by an authorised Merchant of Record identified at checkout and on the receipt/invoice.

Where a Merchant of Record is used, that Merchant of Record is the seller for payment processing purposes and is responsible for processing payments, collecting applicable taxes, issuing receipts or invoices, and handling chargebacks and refunds in accordance with its applicable terms.

Where no Merchant of Record is used, PulsGPT remains the seller for payment purposes, and payments are processed through an authorised payment service provider.

PulsGPT provides the Digital Services themselves, including the technical functionality of the Service and related support, regardless of whether payment is processed directly by PulsGPT or by a Merchant of Record.

9.3. Prepayment and start of performance

Paid Services are provided on a prepaid basis unless expressly stated otherwise.

Performance of Digital Services and/or supply of Digital Content may begin immediately after successful payment confirmation, including by making Subscription resources, Package resources, GPT Tokens, Connections, or other paid functionality available in the User’s Account.

The User acknowledges that some Paid Services may be deemed fully or partially performed immediately after they are credited, activated, or otherwise made available in the Account.

9.4. Subscriptions – billing, renewal and cancellation

Subscription Plans are paid in advance for each Subscription Period.

Before the User completes the purchase of a Subscription Plan, the Service shall clearly indicate whether the Subscription renews automatically, the billing frequency, the amount or pricing basis for renewal, and the available cancellation method.

A Subscription Plan may renew automatically if such functionality is offered and enabled at the time of purchase. Where automatic renewal applies, the User authorises the applicable payment processor or Merchant of Record to attempt to charge the applicable renewal amount for the next Subscription Period using the payment method designated for renewal.

If renewal payment is not successfully completed, PulsGPT and/or the applicable payment processor or Merchant of Record may make repeated payment attempts using the payment method or renewal mechanism available under the relevant payment setup.

The User may cancel a Subscription at any time. Cancellation prevents future renewal and takes effect at the end of the current paid Subscription Period. Cancellation does not entitle the User to a refund for the current Subscription Period except where mandatory law provides otherwise.

Where technically available, cancellation shall be possible through the User’s Account or through another reasonably simple method indicated at checkout or in the purchase confirmation.

If all renewal attempts fail and the Subscription is not successfully renewed, the Subscription ends at the end of the last paid Subscription Period. The consequences of Subscription end, including loss of access to inactive rolled-over GPT Tokens, are governed by these Rules.

9.5. Packages (one-off purchases)

Packages are one-off purchases and do not renew automatically.

The contents, scope, and validity period of each Package are shown before purchase and are further governed by these Rules, including the provisions relating to Package Periods, Connections, GPT Tokens, and Active OLX Account limits.

Unused resources from a Package expire in accordance with these Rules and are not restored after expiry unless mandatory law provides otherwise.

9.6. Consumer right to cancel

If the User is a Client (consumer), the User may have the right to cancel the purchase within 14 days without giving any reason, to the extent provided by applicable law.

Where a purchase is processed by a Merchant of Record, the exercise of the consumer’s cancellation or withdrawal rights may be handled in accordance with the applicable terms and procedures of that Merchant of Record, as presented at checkout and in the relevant receipt or invoice.

Nothing in these Rules limits any mandatory statutory cancellation, withdrawal, refund, or consumer protection rights that cannot legally be excluded or restricted.

9.7. Refunds

Refunds are available to the extent required by applicable law or expressly provided by the applicable payment processor, Merchant of Record, or PulsGPT.

Where a purchase is processed by a Merchant of Record, refunds, chargebacks, payment reversals, and related requests are handled by that Merchant of Record in accordance with its applicable terms and policies.

Where a purchase is processed directly by PulsGPT through a payment service provider and a refund is required by applicable law or voluntarily approved by PulsGPT, the refund will be made using the original payment method where possible and within the time required by applicable law.

Without limiting any mandatory legal rights, refund requests may be considered in particular in cases of duplicate billing, unauthorised renewal, technical non-delivery of a Paid Service, material billing error, or other comparable circumstances.

Refund approval in one case does not create an obligation to grant refunds in other cases.

9.8. How to request a refund or cancellation

Where a purchase is processed by a Merchant of Record, cancellation and refund requests should be submitted using the instructions provided at checkout, in the receipt or invoice, or through the support channels indicated by that Merchant of Record.

Where a purchase is processed directly by PulsGPT, the User may submit a cancellation or refund request to PulsGPT support using the contact details provided in these Rules or on the Website.

PulsGPT may assist the User by providing purchase identifiers, transaction references, or technical information reasonably necessary to process a cancellation, refund, or support request.

10 . Intellectual Property; Licence; Restrictions; Indemnity

10.1. Intellectual property

The Website and the Service (including software, interfaces, design, trademarks and documentation) are owned by PulsGPT or its licensors and are protected by applicable intellectual property laws.

10.2. Licence

Subject to these Rules and timely payment (where applicable), PulsGPT grants the User a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for the User’s internal purposes.

10.3. Restrictions

The User must not:

  • copy, modify, create derivative works, distribute, sell, rent, lease, sublicense or otherwise exploit the Service;
  • reverse engineer, decompile or attempt to derive source code or underlying methods;
  • bypass or circumvent technical limitations, quotas or access controls;
  • use the Service to build a competing product;
  • use the Service in a manner that violates applicable law or third-party rules (including OLX rules).

10.4. Indemnity (short)

To the extent permitted by applicable law, the User agrees to indemnify and hold PulsGPT harmless from third-party claims, damages, liabilities, penalties and reasonable costs arising from the User’s content, messages, use of OLX Accounts, or violation of applicable law or third-party rules.

11 . Illegal Actions and Actions Contradicting the Rules

11.1. General obligations

The User must use the Service in line with its purpose and must not:

  • disrupt the functioning of the Service or compromise security;
  • circumvent technical limits or access controls;
  • transmit unlawful content;
  • infringe intellectual property or privacy rights; or
  • misuse Bots for spam, harassment, deception or other unlawful practices.

11.2. Measures in case of violations

In case of serious or repeated violations, PulsGPT may:

  • suspend or delete Bots;
  • suspend or permanently block the Account;
  • refuse to provide future services; or
  • notify competent authorities or affected third parties where appropriate.

Where reasonably feasible and not prohibited by law, PulsGPT will provide the User with notice of the measure taken and the main reason for it. The User may contact PulsGPT support to request review of the decision.

Nothing in this clause prevents PulsGPT from taking immediate action without prior notice where this is reasonably necessary to address security threats, fraud, legal risk, abuse, or likely harm to third parties, the Service, or external platforms.

Refund and cancellation matters (if applicable) are governed by Section 9 and the applicable payment processor or Merchant of Record terms.

12 . Final Provisions

12.1. Changes to the Rules

PulsGPT may amend these Rules for organisational, legal, technical, security, or economic reasons, including changes in tariffs, payment methods, the scope of Paid Services, legal requirements, or the operation of third-party services.

Material changes will be communicated by publication on the Website and/or via the Account or email, where available. Unless mandatory law requires otherwise, changes take effect on the date specified by PulsGPT, not earlier than 15 days from publication for existing Users, except where a shorter period is necessary due to legal obligations, urgent security reasons, fraud prevention, or technical necessity.

12.2. Materially adverse changes

Where a change materially affects the User’s payment obligations, recurring billing terms, use of personal data, dispute handling, limitation of liability, or other core contractual rights or obligations, PulsGPT may require the User to expressly accept the updated Rules before continuing to purchase or use Paid Services after the effective date of such change.

12.3. Non-acceptance of changes

A User who does not accept an updated version of the Rules may stop using the Service and terminate the Account agreement at any time by deleting the Account or notifying PulsGPT. If express acceptance is required for a material change and the User does not provide it, PulsGPT may limit or discontinue further access to Paid Services after the end of any already paid period.

12.4. Applicable law and jurisdiction

Unless mandatory law provides otherwise, these Rules are governed by the law of Ukraine. This choice does not deprive Clients (consumers) of protection granted by mandatory provisions of the law that would apply in the absence of such choice.

Disputes shall be submitted to competent courts of general jurisdiction, unless mandatory consumer law grants the Client the right to choose another court.

12.5. Language versions

The Rules may be available in multiple languages. In case of discrepancies, the version designated by PulsGPT as primary shall prevail.
